|
The purpose of criminal trials is to determine "guilt" or "innocence." Why do we need a trial to determine guilt or innocence in situations where video cameras capture & record a person committing a criminal act?
Why have a trial for some jerk who walks into a convenience store and shoots the store clerk dead if all of this is captured on video? The issue of guilt/innocence has already been determined by the camera. Criminals who have been caught red-handed in this manner should go straight to sentencing, no trial necessary. Furthmore, there should be NO appeals allowed in these cases...straight to sentencing and then implemment the sentence immediately.
Let's start killing the killers in a more timely manner! |

Because it establishes a sence of fairness to everybody.
The founding fathers established fair trials, because from harrsment from British officials and judges. ( i won't go into specific details) The whole purpuse of the American Constitution is fairness and equality to everyone |

Trails are for the purpose of determining guilt or innocence. When we watch on video a 7-11 store clerk being blown away by scumbag A, we do not need a trial to tell us that scumbag A commited murder. |

| There are countless cases in which clear evidence like a camera is not present, and its just to make sure the guilty are guilty and inoccent inoccent. Without trials and atleast the image of fairness in a country, you get communism. |

Wasn't talking about instances where video isn't invovled. From the outset, my entire proposition has been about video captured murder. When you watch someone blow the head off another person on a security video, the issue of guilt/innocence has been settled...hence, no trial necessary...move on to sentencing...execute the bastard immediately...no appeals because there is nothing to appeal. |

Yes, but according to constitution everyone has the right to a trial, and security vids cameras arent great quality, u can edit pic. And though undoubtly some criminals would be rightusly convicted, it would be so easy to frame someone into murder.
The American trial system isnt fool proof but it does try its best to establish justice. |

It may not be fair, but it is 100% legal under our system of representative gov't. Amendment 10 gives all 50 states their individual right to make criminal law, respectively, and set punishments as they see fit. There is no constitutional requirement that Virginia's criminal code give the same punishment for robbery as Alaska' criminal code.
I am more concerned about the endless appeals process afforded today's criminal and the very lenient sentences handed out for serious crime. |

Criminal laws have becomed more and more uniform over the years anyway, and this is 2007, not 1907. It really doesnt make much sense anymore if you ask me. |

As I said, I don't give two craps if one robber gets 20 years in prision and another robber gets 15 years in prision.
They are both scum and not worth one second of worry or consideration. If you want to address a serious imbalance in fair treatment between citizens, then take up the cause of our tax code. Currently, the top 10% of wage earners are being forced to pay almost 60% of all the income taxes in this country. The lower 45% of wage earners get off scot free...they pay NO income taxes. It is extremely unfair to force so few americans to support the majority of services & programs while other pay nothing. They should be forced to pay, period!! |

| Trials are neccessary to avoid starting to climb the slippery slope to a big brother dictatorship. If you decide not to use trials in certain cases, it will eventually happen that trials are not used at all...this would be terrible...it would tear apart any loosely pieced together justice system this world has. |

| The naive of America loves the notion of a fair and equitable trial. But let's face it, trials are rarely such. Those with tremendous funds at their disposal and hire talented and well resourced attorneys who could manipulate the pool of jury and then further manipulate the jury themselves to twist the truth until it shatters. And for the poorest of defendants, well, they would be at the whim often of 12 individuals with no legal experience. These 12 individuals cannot possibly have the intelligence and knowledge at their disposal to sort truth from lies, to separate their biases from their decision making, to even consider all evidence in their entirety. Our trial system is a mess because it relies on people. And often poorly educated people at that. Why should we subject people to this manipulable and ineffective system? |
